Welcome to Mystic Draw. These Terms and Conditions govern your access to and use of the Mystic Draw website, apps, content, readings, diary features, subscriptions, and related services (together, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms and Conditions.

1. Who we are

2. Eligibility

You must be at least 18 years old to create an account or use paid features of the Service.

By using the Service, you confirm that:

  • you are at least 18 years old;
  • you are legally capable of entering into a binding agreement; and
  • the information you provide is accurate and current.

If you are under 18, you must not use the Service.

3. Nature of the Service

Mystic Draw is a digital reflection and tarot-reading platform that may include:

  • tarot card draws;
  • AI-generated interpretations and summaries;
  • weekly zodiac readings;
  • diary or note-taking features;
  • card encyclopedia content;
  • profile and account management features;
  • plan and subscription management; and
  • optional cosmetic, theme, or other digital extras.

Mystic Draw is designed to support reflection, journaling, and personal insight. It is not designed to replace human judgment, licensed advice, emergency support, or professional services.

4. Important disclaimer: tarot, AI, and no professional advice

Mystic Draw provides AI-assisted tarot and reflection content for personal insight, journaling, self-reflection, and entertainment.

The Service does not provide:

  • medical advice;
  • mental health treatment or crisis support;
  • legal advice;
  • financial advice;
  • tax advice;
  • investment advice;
  • professional relationship counselling; or
  • any other licensed professional service.

You must not rely on any reading, summary, suggestion, card interpretation, prompt, or generated content as a substitute for professional advice.

You remain solely responsible for your own decisions, actions, and outcomes.

If you are experiencing a medical emergency, mental health crisis, risk of self-harm, danger, abuse, or any urgent situation, do not rely on Mystic Draw. Contact emergency services, a qualified health professional, or an appropriate crisis support service immediately.

We do not guarantee that any reading:

  • is accurate;
  • is complete;
  • is suitable for your circumstances;
  • will lead to a particular result; or
  • is free from ambiguity, bias, mistakes, or unwanted interpretations.

AI systems can generate incorrect, incomplete, generic, inconsistent, or unsuitable content. Tarot content is inherently interpretive and subjective. You acknowledge and accept both of those limitations.

5. Account registration and security

To access some features, you may need to register for an account.

You agree to:

  • provide true, accurate, and complete registration information;
  • keep your account details updated;
  • keep your password and login credentials secure;
  • not share your account with others; and
  • notify us promptly if you suspect unauthorized access to your account.

You are responsible for all activity carried out through your account unless caused by our own breach of security obligations.

We may require identity or ownership verification before acting on some account requests, including deletion, email changes, or dispute handling.

6. Plans, subscriptions, billing, upgrades, and downgrades

Mystic Draw may offer free and paid plans, including plans such as Lite, Regular, and Premium. Features, limits, and pricing may change from time to time.

Current plan details shown on the Service at the time of purchase form part of these Terms.

6.1 Paid subscriptions

If you purchase a paid plan:

  • you authorize us and our payment provider to charge the applicable fees;
  • you must provide valid payment information;
  • recurring subscriptions may renew automatically unless cancelled before the next billing cycle, where applicable; and
  • access to paid features may continue only while payment remains valid and up to date.

6.2 Upgrades

If you upgrade your plan, the new price, billing treatment, and feature access will be shown at checkout or in your account settings. We may apply the change immediately or from the next billing cycle, depending on the payment flow in use.

6.3 Downgrades

If you downgrade:

  • reduced features may apply immediately or at the next renewal date, depending on the plan and payment flow;
  • content associated with paid features may become read-only or inaccessible while you remain on a lower plan; and
  • we may keep that data for a reasonable period in case you upgrade again, unless you request deletion.

6.4 Failure to pay

If a charge fails, we may:

  • retry the payment;
  • suspend paid features;
  • move your account to a free plan;
  • restrict access to new readings or notes; or
  • cancel the relevant subscription.

You remain responsible for amounts properly owed for the billing period already provided to you.

7. Refunds

Unless otherwise required by law, subscription fees and digital purchase fees are generally non-refundable once the relevant billing period or digital access has started.

However, we may choose to provide a refund, credit, or goodwill adjustment in our discretion, including where:

  • duplicate billing occurred;
  • a technical failure materially prevented access to paid features;
  • a charge was clearly made in error; or
  • consumer law requires a remedy.

Nothing in these Terms excludes any rights you may have under applicable consumer protection laws, including non-excludable rights under the Australian Consumer Law.

8. Trial features, beta features, and early access

We may offer trial, beta, preview, experimental, or early-access features.

Those features may:

  • be incomplete;
  • contain bugs or errors;
  • change at any time;
  • be withdrawn without notice; and
  • be subject to extra limits or exclusions.

We provide such features on an “as is” basis unless otherwise required by law.

9. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • upload or submit harmful, abusive, defamatory, hateful, discriminatory, threatening, obscene, or fraudulent content;
  • submit content that infringes another person’s rights;
  • attempt to reverse engineer, scrape, disrupt, overload, or interfere with the Service;
  • bypass usage limits, plan restrictions, access controls, or payment systems;
  • use bots, scripts, or automation in a way that harms the Service or unfairly consumes resources;
  • probe, test, or exploit security weaknesses without authorization;
  • impersonate another person or misrepresent your identity;
  • use the Service to generate or distribute spam, scams, or manipulative content; or
  • use the Service in connection with emergencies, high-risk decision-making, or regulated professional activity.

We may investigate suspected misuse and take action including suspension, removal of content, cancellation of subscriptions, blocking access, or reporting unlawful conduct where appropriate.

10. User content, diary entries, and submissions

You may be able to submit content such as diary notes, prompts, profile details, feedback, support messages, and context you provide for readings (“User Content”).

You retain ownership of your User Content.

By submitting User Content through the Service, you grant us a limited, non-exclusive, revocable, worldwide license to host, store, process, transmit, reproduce, and display that User Content only as reasonably necessary to:

  • provide the Service to you;
  • generate readings and summaries;
  • maintain your account;
  • secure and improve the Service;
  • respond to support requests;
  • comply with law; and
  • enforce these Terms.

We do not claim ownership of your personal diary notes.

You represent that:

  • you have the rights needed to submit your User Content;
  • your User Content does not violate law or third-party rights; and
  • your User Content does not contain malware, malicious code, or harmful material.

We may remove or restrict User Content if we reasonably believe it violates these Terms, applicable law, or the rights or safety of others.

11. Feedback

If you submit ideas, suggestions, comments, bug reports, or feature requests, you agree that we may use them without restriction or compensation to you, unless otherwise agreed in writing.

12. Intellectual property

All rights, title, and interest in the Service, including software, design, branding, logos, graphics, interfaces, text, compilations, card layouts, generated output formatting, and original Mystic Draw content, are owned by us or our licensors.

Except as expressly allowed by these Terms, you must not:

  • copy, reproduce, republish, sell, license, or distribute our content;
  • modify or create derivative works from our software or branded materials;
  • use our trademarks, name, or branding without permission; or
  • remove proprietary notices.

Any third-party names, decks, marks, or materials remain the property of their respective owners.

13. Card art, decks, and third-party materials

Some parts of the Service may include or refer to third-party materials, including payment systems, analytics tools, hosting, card art, font assets, or public-domain resources.

Use of those materials may also be subject to third-party terms, licenses, or restrictions.

Where we provide deck themes or artwork, your access is limited to personal use within the Service unless we expressly state otherwise.

14. Service availability and changes

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability.

We may, at any time and without liability, to the extent permitted by law:

  • modify features;
  • add or remove tools, plans, or limits;
  • suspend access for maintenance, upgrades, security, or technical reasons;
  • discontinue part of the Service; or
  • stop offering the Service in particular regions or to particular users.

Where reasonably practical, we will try to give notice of material changes.

15. Usage limits and fair use

We may impose reasonable limits on use, including:

  • number of readings;
  • number of diary entries;
  • size of uploads or entries;
  • API or background requests;
  • storage allocation;
  • deck availability;
  • context length; and
  • premium feature frequency.

These limits may vary by plan, beta status, technical needs, fraud prevention, or fair use controls.

Abnormal, abusive, or automated use may result in throttling, suspension, or account review.

16. Third-party services

The Service may integrate with third-party services such as payment providers, email delivery providers, hosting providers, analytics providers, customer support tools, authentication tools, or cloud platforms.

We are not responsible for third-party services, their availability, or their separate terms, policies, or practices.

Your use of third-party services may be governed by separate agreements between you and those third parties.

17. Privacy

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information.

By using the Service, you acknowledge that we may handle your personal information in accordance with our Privacy Policy.

18. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free;
  • readings or outputs will be accurate, reliable, or appropriate;
  • stored content will never be lost, corrupted, delayed, or unavailable;
  • defects will always be corrected; or
  • the Service will meet your expectations or intended outcomes.

You are responsible for maintaining your own backups of any content important to you, including diary entries and exported data.

19. Limitation of liability

To the maximum extent permitted by law, Mystic Draw and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including loss of profits, revenue, goodwill, opportunity, data, or business interruption.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms will be limited to the greater of:

  • the amount you paid us for the Service in the 3 months before the event giving rise to the claim; or
  • AUD $100.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, including rights under applicable consumer laws.

Where a law implies a non-excludable guarantee, our liability is limited to the minimum extent permitted by law.

20. Indemnity

You agree to indemnify and hold harmless Mystic Draw and its related parties from and against claims, liabilities, losses, damages, costs, and expenses, including reasonable legal costs, arising out of or related to:

  • your misuse of the Service;
  • your User Content;
  • your breach of these Terms; or
  • your violation of law or third-party rights.

This clause applies only to the extent permitted by law.

21. Suspension and termination

We may suspend or terminate your access, in whole or in part, immediately or on notice, if:

  • you breach these Terms;
  • payment fails or is reversed;
  • we suspect fraud, abuse, unlawful conduct, or security risk;
  • we are required to do so by law; or
  • continuing to provide the Service is no longer commercially or technically feasible.

You may stop using the Service at any time. You may also request account deletion in accordance with our Privacy Policy.

On termination:

  • your rights to use the Service end;
  • paid access may end immediately or at the end of the current billing period, depending on the reason and legal requirements;
  • some data may remain in backups for a limited time; and
  • clauses that should survive termination will continue, including those about payments owed, intellectual property, disclaimers, liability, disputes, and indemnity.

22. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia, unless mandatory law in your place of residence applies differently.

You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia, subject to any rights you may have under mandatory consumer laws.

23. Changes to these Terms

We may update these Terms from time to time.

If we make a material change, we may provide notice by posting the updated Terms on the Service, updating the “Last updated” date, sending email notice, or by another reasonable method.

Your continued use of the Service after updated Terms take effect means you accept the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force to the extent possible.

25. Entire agreement

These Terms, together with the Privacy Policy and any plan-specific terms shown to you at checkout or in-product, form the entire agreement between you and Mystic Draw regarding the Service.
